Specific areas of Law

Immigration Law

The U.S. immigration law entails the filing of petitions and or applications in order to obtain legal status in the United States for a temporary stay as well as a stay for a longer period, to study, work, or live in the United States permanently.

We regularly represent companies hiring a foreign national, as well as foreign individuals.  We assist these individuals in obtaining work authorization, or establishing permanent residency in the U.S.  (green card).  We also assist in establishing subsidiary or affiliate companies of a foreign company and management of U.S. or European companies.

Business Law

Another area of law that we focus on is the creation and the management of companies, such as a corporation, a limited liability company, a partnership, or a joint venture.  Especially the management of a joint venture requires both legal knowledge as well as an understanding for the business and potential intercultural problems that may arise during the creation and the life thereof.  We create companies internationally, especially in England, the U.S., as well as in Switzerland and in Germany.

 

Enforcement of foreign judgments in the United States as well as in Germany

The enforcement of a foreign judgment can be challenging, especially if one is not very familiar with the other country's legal system.  We advise and assist our clients in the recognition process of foreign judgments and their enforcement.

 

Probate and Family Law

As a law office that focuses on international la international probate and family law is another area of law we are focusing on.  Special expertise is required and can be provided by us with respect to international probate and family law matters, especially in relation to Germany.  For example, if you are inheriting assets, that are located in Germany and you have completed the probate process in the United States, this does not automatically mean that you can obtain the assets located in Germany.  In fact, you would have to go through the German probate process again.  This can be very burdensome and extensive; knowledge of the other country's probate law is required to be successful.  Due to our competency, we can represent you in the U.S. as well as in Germany.

Problems also arise in international divorce matters.  Where should you file for divorce, in the United States or in another country?  Which law is applicable?  Can you take your child with you or can you ensure that your child's stays in the United States and does not move back to where one parent may come from?  These questions may concern you when considering a divorce and the appropriate steps need to be planned.

Of course, general probate law, estate planning, wills and trust law, and "standard divorce cases” are handled by our firm as well.

Rechtsanwaltskanzlei PECHER has been founded by attorney Mandy Pecher , LL.M., MBA.
 
Our attorneys and other staff members have all worked or studied in a foreign country.  Our German attorneys are licensed to practice law in Germany, regardless of the German state, including all district, circuit, and German supreme courts.  This is a great advantage for you because it means that our team's competence is based on well-grounded higher university education in their home country and internationally as well as practical experience through international work.

Because our professional expertise is comprised of immigration law as well as business law, we require our employees to not only have a legal educational background but also an educational background in business administration or business finance and international work experience.  Business oriented knowledge and expertise is tremendously important to fully advise you in international business transaction matters, and running a business in a foreign country most efficiently.

Our team members have a Master either in Business Administration (MBA), a Master of Law (LL.M.) or a "Fachanwalt" certification in their area of expertise.

Generally, fees are one of the least discussed parts of any legal case and usually fees are not discussed early enough, candidly enough, or in enough detail.  There are two primary reasons for that (1) the discussion can be uncomfortable for you; and (2), the discussion can also be uncomfortable for the attorney.

We would like to provide you with an overview of the types of fee arrangements we use in our office to make you feel more comfortable.

Due to our areas of specializations, we offer three different fee structures to address our clients' need.  Depending on the area of law, we either bill on an hourly basis or we provide a flat fee.  Some matters are also handled on a contingency fee.
