Apostillen
Oft brauchen deutsche Staatsangehörige Kopien von Urkunden und dazu Beglaubigungen.
Beglaubigte Urkunden nach dem deutschen Beurkundungsgesetz zu erhalten, ist nicht ganz einfach.
Teilweise wird geglaubt, dass ein amerikanischer sogenannter Public Notary solche Beglaubigungen vornehmen kann. Dies ist nicht richtig, denn Public Notary kann unter bestimmten Voraussetzungen fast jeder werden. Eine juristische Ausbildung ist hierfür nicht erforderlich!
Abhängend von der Art der Beglaubigung können sogenannte Apostillen beantragt werden.
Eine Apostille ist die vereinfachte Form der Legalisierung einer Urkunde zwecks Verwendung im Ausland oder in Ihrem Fall gegebenenfalls in Deutschland, wobei die Echtheit der Unterschrift ohne Mitwirkung eines Konsuls durch eine inländische Behörde bestätigt wird.
Ob im Einzelfall eine Apostille ausreichend ist, ergibt sich aus den zwischenstaatlichen Abkommen.
Falls eine Apostille nicht ausreichend ist, z.B. bei Erbschaftssachen, muss das zuständige Generalkonsulat kontaktiert werden.
